29 CFR 1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: a) Marble Cutting Area: On or about January 10, 2023, and at times prior thereto, employees were exposed to continuous noise levels at 183.1 % of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 183.1 % is approximately 94.3 dBA. Sampling was performed for 460 minutes during one shift, not including the lunch break, without having annual audiometric testing. b) Finishing Polish Marble Area: On or about January 10, 2023, and at times prior thereto, employees were exposed to continuous noise levels at 53.4 % of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 53.4 % is 85.4 dBA. Sampling was performed for 380 minutes during one shift, not including the lunch break, without having annual audiometric testing.
