OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Consumers Supply Distributing, LLC at 718 North Derby Lane, North Sioux City, SD 57049: On or about and at times prior to January 15, 2024, the employer did not ensure employees were protected from crushing hazards when performing work under suspended flexible intermediate bulk containers on the tote filling station. This condition exposed employees to crushing hazards. Abatement Note: Among other methods, one feasible and acceptable abatement method to control this hazard is to comply with the Flexible Intermediate Bulk Container ("FIBC") Association's FIBC Safe Handling Guidelines for emptying FIBC: Never allow personnel to stand or place any appendage under a suspended FIBC. All personnel must be safely clear of any potential hazard when lifting, handling or emptying an FIBC.

29 CFR 1910.29(b)(13)(i): The guardrail system opening used around holes that serve as points of access (such as ladderways) did not have a self-closing gate: (a)Consumers Supply Distributing, LLC at 718 North Derby Lane, North Sioux City, SD 57049: On or about and at times prior to January 9, 2024, the employer did not ensure that employees were protected from fall hazards when performing work on the top level of the elevated work platforms on the dryer of the extrusion line in that an appropriate fall protection system was not implemented when an employee was working in proximity to the platform's ladderway and fell sustaining serious injuries. This condition exposed employees to fall hazards of greater than four feet.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a)Consumers Supply Distributing, LLC at 718 North Derby Lane, North Sioux City, SD 57049: On or about and at times prior to January 11, 2024, the employer did not ensure employees were protected from caught-between hazards created by movement of the massager plates on the tote filling station. Sufficient guarding was not implemented to prevent employees being caught between the massager plates and a suspended flexible intermediate bulk container ("FIBC") and/or being caught between the massager plates and other components of the tote filling station during actuation of the massager plates. This condition exposed employees to caught-between hazards.
