29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about January 16, 2024, located at 2094 Rankin Avenue, Columbus, Ohio, 43219: The employer failed to initiate and maintain safety and health programs that included work rules, hazard recognition, and enforcement of those rules.  Employees were repairing a sewer line to a residential home working inside a trench that was approximately 7-feet deep without any cave-in protection, the spoils pile within approximately 2 to 3 inches from the sides and edges of the trench and no head protection in place. Thereby exposing the employees to struck-by and caught-in hazards on the jobsite.

29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   a. On or about January 16, 2024, located at 2094 Rankin Avenue, Columbus, Ohio, 43219: The employer did not ensure employees were instructed on the recognition and avoidance of any unsafe conditions applicable to the work being performed. Employees were working in a 7-foot deep trench and operating a Bobcat E35 mini excavator while working to replace a sewer line at a residential home without being instructed on hazards of the job and how to mitigate the hazards, exposing the employees to struck-by hazards.

Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  a. On or about January 16, 2024, located at 2094 Rankin Avenue, Columbus, Ohio, 43219: The employer did not ensure that excavated materials that posed a hazard of falling into the excavation were at least 2-feet from the edge of the excavation.  Employees were exposed to struck-by and caught-in hazards while working in a trench with the spoils pile in areas approximately 2 to 3 inches from the side of the trench.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  a. On or about January 16, 2024, located at 2094 Rankin Avenue, Columbus, Ohio, 43219: The employer failed to provide a competent person to conduct a daily inspections of a trench and adjacent areas when employees were working in the trench.

29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  a. On or about January 16, 2024, located at 2094 Rankin Avenue, Columbus, Ohio, 43219: The employer failed to ensure employee were protected from trench cave-ins by an adequate protective system while the employees were performing sewer drain pipe replacement work inside a trench that was approximately 7-feet deep with a vertical face.  Employees were working in the trench without any protective system in place, thereby exposing the employee to struck-by and caught-in hazards.
