29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time weighted average sound level (TWA) of 85 dBA: (a) Cumberland Area - On or about January 12, 2024, a Recycler was exposed to continuous noise at a dose of 211% or an equivalent time-weighted average of 95 dBA, which is in excess of the 85 dBA Action level, during a 410-minute sampling period on 02-13-2024. Exposure calculations included a zero increment for the time not sampled. (b) Grinder 1 Area - On or about January 12, 2024, a Recycler was exposed to continuous noise at a dose of 84% or an equivalent time-weighted average of 89 dBA, which is in excess of the 85 dBA Action level, during a 390-minute sampling period on 02-13-2024. Exposure calculations included a zero increment for the time not sampled. (c) Vecoplan Retech Shredder Area - On or about January 12, 2024, a Recycler was exposed to continuous noise at a dose of 74% or an equivalent time-weighted average of 89 dBA, which is in excess of the 85 dBA Action level, during a 411-minute sampling period on 02-13-2024. Exposure calculations included a zero increment for the time not sampled.

29 CFR 1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: (a) Facility - On or about January 12, 2024, the employer had not developed and implemented a written hazard communication program governing the usage of chemicals in the facility, such but not limited AW 32 Anti Wear Hydraulic Oil, Hydraulic Fluid, Brake Cleaner, and etc., exposing employees to hazardous chemicals.
