OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to potential fire, deflagration and explosion hazards associated with combustible wood dust. a) Production floor: Employees were exposed to fire, deflagration and explosion hazards due to the Belfab Bel Series dust collection system, model BEL150XL which was collecting combustible dust from two different woodworking machines, and located within the building, on or about 1/17/2024. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The employer required a painters to wear 3M 6200 half face elastomeric respirator, throughout the shift while painting materials. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
