29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about January 18, 2024, at the establishment located at 1700 Division Street, New London, Wisconsin: the employer failed to complete the required training to include classroom training for employees operating powered industrial vehicles.

On or about January 18, 2024, at the establishment located at 1700 Division Street, New London, Wisconsin; the employer did not evaluate each powered industrial truck operator's performance to ensure they had the knowledge and skill to operate safely.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  On or about January 18, 2024, at the establishment located at 1700 Division Street, New London, Wisconsin: Nissan 50 Forklift (Model: CPJ02A25PV Serial: CPJ02-9P5437) was operated with damaged tires. Damage to the tires was found to include, but was not limited to, chunks of tire missing, severe splitting of sidewalls and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  On or about January 18, 2024, at the establishment located at 1700 Division Street, New London, Wisconsin; employer was not ensuring employees were conducting inspections prior to use. A Nissan 50 Forklift (Model: CPJ02A25PV Serial: CPJ02-9P5437) was operated with damaged tires. Damage to the tires was found to include, but was not limited to, chunks of tire missing, severe splitting of sidewalls and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.

29 CFR 1910.252(b)(2)(iii): Protection from arc welding rays. Where the work permits, the welder should be enclosed in an individual booth painted with a finish of low reflectivity such as zinc oxide (an important factor for absorbing ultraviolet radiations) and lamp black or shall be enclosed with noncombustible screens similarly painted. Booths and screens shall permit circulation of air at floor level. Workers or other persons adjacent to the welding areas shall be protected from the rays by noncombustible or flameproof screens or shields or shall be required to wear appropriate goggles.  On or about January 18, 2024, at the establishment located at 1700 Division Street, New London, Wisconsin; in the weld area, the employer did not ensure that welding work performed was enclosed by an individual booth, noncombustible or flameproof screens, or requiring the use of appropriate goggles to protect employees working in the adjacent area from ultraviolet radiation generated by welding, exposing employees to the hazards associated with ultraviolet radiation.
