29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from fling particles:  (a)Luis Villanueva at 1345 Michigan Avenue Southwest, Huron, SD 57350:  On our about and at times prior to October 17, 2023, the exposing employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles while conducting roofing operations and utilizing pneumatic nail guns.  This condition exposed employees to struck by hazards.

29 CFR  1926.501(b)(10):Employees engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  (a) Luis Villanueva 1345 Michigan avenue Southwest, Huron SD, 57350: On or about and at times prior to October 17, 2023, the exposing employer did not ensure that employees that were performing roofing operations on a 4/12 pitch commercial property were protected from falls.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a)Luis Villanueva at 1345 Michigan Avenue Southwest, Huron, SD 57350: On or about and at times prior to October 17, 2023, the exposing employer did not ensure employees were trained to recognize fall hazards and the procedures to minimize these hazards, prior to employees being exposed while conducting roofing operations on a commercial property. This condition exposed employees to fall hazards greater than six feet.
