29 CFR 1910.134(d)(1)(i): The employer did not select and provide an appropriate respirator based on the respiratory hazard(s) to which employees are exposed, including workplace hazards and user factors that affect respirator performance and reliability. a) Production floor- Polishing Area: On or about January 18, 2024, and at times prior, employees were exposed to respiratory hazards associated with Silica, in that the employer failed to ensure that respiratory protection was provided to employees operating polishing machine and exposed to Crystalline Silica at 37 �g/m3, and above the OSHA action level 25�g/m3.

29 CFR 1910.1053(i)(2): The employer did not make available an initial (baseline) medical examination within 30 days after initial assignment when the employee had not received a medical examination that meets the requirements of this section within the last three years: a) Production floor - Polishing Area: On or about January 18, 2024, and at times prior, the employer exposed employees to health hazards associated with Silica, in that the employer failed to ensure that employees were provided with medical surveillance when employees were exposed to Crystalline Silica at 37 �g/m3, and above OSHA action level of 25�g/m3 while operating polishing machine.
