29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Location: Job site; On or about 01/19/2024, multiple employees were not protected from falling to a lower level by the use of guardrail systems, safety nets, or personal fall arrest systems in the following instances: a) 6 Employees were not protected from a fall of 9-feet to the concrete floor of the second level while performing framing activities on the floor joists of the 3rd story. b) An employee was witnessed reaching outside the guardrail system erected at the top of the structure in order to secure exterior building materials with a pneumatic nail gun, exposing them to a fall of approximately 18-feet to the ground below.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a ridged support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the the ladder. Location: Job site; On or about 01/19/2024, employees were allowed to utilize Werner LEANSAFE ladders in a closed position which did not extend 3-feet above the upper landing surface of the 3rd story floor joists which they were being used to gain access to.
