Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a.) On or about January 9, 2024, the employer did not ensure employees welding wore personal protective flame retardant personal protective clothing to protect the torso and upper extremities from weld splatter and sparks produced while repairing and refurbishing stainless and carbon steel components.

29 CFR 1910.1026(c): Permissible exposure limit (PEL). The employer shall ensure that no employee is exposed to an airborne concentration of chromium (VI) in excess of 5 micrograms per cubic meter of air (5 �g/m3), calculated as an 8-hour time-weighted average (TWA). a.) On or about January 31, 2024, a welder was exposed to an 8-hour time weighted average (TWA) of 15.97 �g/m3 for Chromium (VI), approximately 3.194 times the Permissible Exposure Limit (PEL) of 5.0 �g/m3. The exposure level was derived from a sample collected over a 443 minutes sampling period with zero exposure assumed for the unsampled period of 37 minutes.

29 CFR 1910.1026(f)(1)(i):Except as permitted in paragraph (f)(1)(ii) and paragraph (f)(1)(iii) of this section, the employer shall use engineering and work practice controls to reduce and maintain employee exposure to chromium (VI) to or below the PEL unless the employer can demonstrate that such controls are not feasible. Wherever feasible engineering and work practice controls are not sufficient to reduce employee exposure to or below the PEL, the employer shall use them to reduce employee exposure to the lowest levels achievable, and shall supplement them by the use of respiratory protection that complies with the requirements of paragraph (g) of this section. a.) On or about January 31, 2024, a welder was exposed to an 8-hour time weighted average (TWA) of 15.97 �g/m3 for Chromium (VI), approximately 3.194 times the Permissible Exposure Limit (PEL) of 5.0 �g/m3. The exposure level was derived from a sample collected over a 443 minutes sampling period with zero exposure assumed for the unsampled period of 37 minutes. The employer did not enforce the use of the DiversiTech ECO2-01-06-010N1 wall mounted fume extractor located in Aisle 2 on column E4B and did not ensure it was sufficient to reduce employee expsoure below the Chromium (VI) PEL.
