29 CFR 1910.1053(d)(3)(i):The employer did not perform initial monitoring to assess the 8-hour TWA exposure for each employee on the basis of one or more personal breathing zone air samples that reflect the exposures of employees on each shift, for each job classification, in each work area: Employees engaged in cutting countertops at 101 countertops located at 2828 - 2824 148th Avenue Circle, Omaha, Nebraska were exposed to respirable silica that can cause permanent damage to the lungs. This was most recently documented on January 23, 2024. The employer failed to conduct initial monitoring of employees exposed to crystalline silica above the prescribed action level.

29 CFR 1910.1053(i)(1)(i): The employer shall make medical surveillance available at no cost to the employee, and at a reasonable time and place, for each employee who will be occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year. Employees engaged in cutting countertops at 101 Countertops located at 2828 - 2824 148th Avenue Circle, Omaha, Nebraska, were exposed to respirable silica that can cause permanent damage to the lungs. This was most recently documented on January 23, 2024. The employer is failing to ensure employees exposed to respirable crystalline silica above the action level have conducted medical surveillance.
