29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    On or about January 23, 2024, the employer failed to develop, implement and utilize a Control of Hazardous Energy program where employees are tasked with various tasks, such as but not limited to, clearing jams on machines/equipment, including but not limited to, the Chop Cutter.  An employee sustained a multi finger amputation when clearing a jam on the Chop Cutter.  The machine was not locked and tagged out.

29 CFR  1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:   On or about January 23, 2024, the employer failed to develop, document, and utilize machine specific procedures for clearing of jams on machines, including but not limited to, the Chop Cutter.  An employee sustained a multi finger amputation when clearing a jam on the Chop Cutter.  The machine was not locked and tagged out and there was no procedure in place for this machine.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   a.  On or about January 23, 2024, the employer failed to ensure that effective guarding was in place on the extrusion line at the infeed of the puller belts, including but not limited to, Line 5.  Employees are exposed to caught in pinch point hazards at the infeed of the puller belts when performing the tasks of set up and resetting of the rubber extruded material.  b.  On or about January 23, 2024, the employer failed to ensure that effective guarding was in place on the Chop Cutter which was connected to the end of extrusion line  #5.   The Plexiglas guard in place on the Chop Cutter  did not extend down far enough to prevent someone from accessing the internal components of the cutter, such as the blade and drum.

29 CFR  1910.1200(e)(1): Employer had not developed, implement or maintain a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200:  On or about January 23, 2024, the employer failed to maintain and updated written Hazard Communication program for chemical safety at the facility.  Updates have not been made to the program since 2002. The employer failed to maintain a list of hazardous chemicals, conduct employee training, and maintain safety data sheets. Employees are exposed to chemicals including, but not limited to, Quick Cure.
