1926.651(k)(1) Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. 29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a). On or about January 24, 2024, at 45-02 Northern Boulevard, Astoria, NY 11101. Employees working inside a trench approximately 6-feet in depth building a manhole for access to a gas valve did not have a safe mean of egress located inside the trench. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system. a). On or about January 24, 2024, at 45-02 Northern Boulevard, Astoria, NY 11101. Employees building a manhole inside a 6-ft trench that was missing shoring were exposed to cave-ins hazard. Abatement certification is required pursuant to 29 CFR 1903.19.
