29 CFR  1910.28(b)(3)(i): The employer did not ensure that each employee was protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  (a)Buffalo Ridge Concrete, Inc. at 47197 Winter Place, Sioux Falls, SD 57107:  On or about and at times prior to January 24, 2024, the employer did not ensure that a floor opening measuring 4.5 inches by 5.5 inches, was covered on walking-working surfaces located on the upper level of the batch plant. This condition exposed employees to trip/fall hazards.  (b)Buffalo Ridge Concrete, Inc. at 47197 Winter Place, Sioux Falls, SD 57107:  On or about and at times prior to January 24, 2024, the employer did not ensure that a floor opening measuring 2 inches by 4.25 inches was covered on walking-working surfaces located on the upper level of the batch plant. This condition exposed employees to trip / fall hazards.

This condition exposed employees to caught-in and ingoing nip point hazards hazards.  (b)Buffalo Ridge Concrete, Inc. at 47197 Winter Place, Sioux Falls, SD 57107: On or about and at times prior to January 24, 2024, the employer did not ensure guarding was in place on the McNeilus Model No: 30 x 140 1 11/1 conveyor located in the hopper area. This condition exposed employees to caught-in and ingoing nip point hazards.
