29 CFR  1926.452(w)(6)(v): Employee(s) were permitted on parts of the scaffold which extend outward beyond the caster, wheels, or other supports:  a- 3 Centre Plaza, Tinton Falls NJ: A worker fell, approximately 16 feet 8 inches to the concrete flooring below, when attempting to repair a PVC downspout from an unsecured,  portable, extension ladder that was set on the walking/working surface of a rolling scaffold.  This ladder extended beyond the scaffold's castor, wheels and other supports prior to the incident.  Condition noted on or about 01/23/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a- 3 Centre Plaza, Tinton Falls NJ:  A worker fell, approximately 16 feet 8 inches to the concrete flooring below, when attempting to repair a PVC downspout from an unsecured, portable extension ladder that was set on the walking/working surface of a rolling scaffold.  This worker was not trained nor received training by a person qualified in scaffold hazard recognition and did not understand the procedures to control or minimize those hazards. Condition noted on or about 01/23/24.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(a)(1): Ladders shall be capable of supporting the following loads without failure:  a- 3 Centre Plaza, Tinton Falls NJ: A worker fell, approximately 16 feet 8 inches to the concrete flooring below, when attempting to repair a PVC downspout from an unsecured,  portable extension ladder that was set on the walking/working surface of a rolling scaffold.  This ladder was not capable of supporting its load without failure in the configuration it was set by the worker. Condition noted on or about 01/23/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
