29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On March 06, 2024, employees working on the cranberry production line were exposed to noise levels exceeding 85 dBA, at an 8 hour time weighted average, and were not provided audiograms. a) On March 06, 2024, employee was dumping frozen cranberries into a stainless steel hopper was exposed to 90.23 dBA (80 dB threshold) as an 8 hour time weighted average. Employee was sampled for 381 minutes and and the remaining 99 minutes were calculated as 0 (zero) exposure time. b) On March 06, 2024, employee was making boxes and walking around the production floor was exposed to 89.50 dBA (80 dB threshold) as an 8 hour time weighted average. Employee was sampled for 384 minutes and and the remaining 96 minutes were calculated as 0 (zero) exposure time.
