[59 FR 40738, Aug. 9, 1994; 60 FR 5131, Jan. 26, 1995] a) Jobsite, 99 Matthew Drive, Uniontown, PA: On or about January 24, 2024, an employee was on the on the roof helping two other employees in a scissors lift to place stone caps on the top of the brick facade of a new store front, without fall protection, approximately 22 feet above the ground.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) Jobsite, 99 Matthew Drive, Uniontown, PA: On or about January 23, 2024, two employees were working out of a scissors lift that was not fully protected by a guardrail system nor was fall protection being utilized.
