OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to electrical and struck-by hazards associated with the use of the Reading 5-ton hoist (serial #13304).     a.) Custom Valve Repair, LLC 3589 Harlansburg Road New Castle, PA 16101, on or about 01/25/2024, and times prior thereto: The emergency stop button on the Reading 5-ton hoist serial #13304 pendant was missing. Hoist pendant was used to lift equipment including but not limited to, large control valves.  b.) Custom Valve Repair, LLC 3589 Harlansburg Road New Castle, PA 16101, on or about 01/25/2024, and times prior thereto: Periodic inspections are not performed or documented on the hoists. Hoists include, but is not limited to, Reading 5-ton hoist (Serial number 13304), and Reading 5-ton hoist (Serial number 13305).

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical  a.) Custom Valve Repair, LLC 3589 Harlansburg Road New Castle, PA 16101, on or about 01/25/2024, and times prior thereto: Three chemical containers located in the flammable liquid storage cabinet outside the break room were not labeled correctly in that the containers with a white cap weren't labeled and contained Penncut 150 oil. The company's squeeze bottle cap color code system states that Penncut 150 oil should be in a green cap container and white cap squeeze bottles need a hazard warning label.
