29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before an employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a) Car Wash - On or about January 20, 2024, the employer did not establish a program that included energy control procedures for employees to follow, employee training, and periodic inspections to protect employees from injury caused by the unexpected energization, start up or release of stored energy when performing set up and servicing/maintenance of equipment, including the Tire Shine Machine equipment.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) Car Wash Bay - On or about January 21, 2024, the employer did not did not ensure that the rollers on the Flow Line 30 Car Wash Conveyor equipment, was guarded  to protect the employee's feet from getting caught in the ingoing nip points.      In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
