29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. a) New commercial construction of Sixes Storage located at 455 East Rope Mill, Canton, GA 30115, 4th Floor; On or about 01/22/24, the employer exposed an employee to falls of approximately 42-feet, 10-inches to the lower level, in that a fall protection system was not provided when the employee working from a step ladder at heights over the top guardrail was no longer protected from fall hazards while grinding steel framework.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) New commercial construction of Sixes Storage located at 455 East Rope Mill, Canton, GA 30115, 4th Floor; On or about 01/22/24, the employer exposed employees to falls of approximately 9-feet, 10-inches to the lower level, in that an employee worked from the top step and cap of an A-Frame ladder which is prohibited. Mendez Framing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(13), which was contained in OSHA inspection number 1595385, citation number 1, item number 1, and was affirmed as a final order on 05-19-2022, with respect to a workplace located at Life Storage Units in Kenmore, NY 14223.
