29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 5 Cider Mill Drive Lot 21, Ashville, OH 43103: On or about January 25, 2024, the employer did not initiate and maintain safety and health programs related to the roofing work that included work rules, hazard detection and site safety enforcement. An employee was performing roofing work using pneumatic nail guns without the proper eye protection on the roof of a residential home at heights over 20 feet without any form of fall protection and using an improperly configured ladder for roof access thereby exposing the employees to falls and struck-by hazards.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. Located at 5 Cider Mill Drive Lot 21, Ashville, OH 43103: On or about January 25, 2024, the employer did not instruct their employee in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment. An employee was performing roofing work using a pneumatic nail gun without eye protection on the edge of an 18 foot roof using an improperly configured ladder for roof access and egress thereby exposing the employee to falls and struck-by hazards.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at  5 Cider Mill Drive Lot 21,  Ashville, Oh 43103: On or about January 25, 2024, the employer failed to ensure the employee was wearing appropriate eye protection while operating a pneumatic nail gun to install roofing shingles on a new build two story single family home, the employee was exposed to flying particles to the face and eyes.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Located at 5 Cider Mill Drive Lot 21, Ashville, OH 43103: On or about January 25, 2024, the employer failed to ensure the employee was protected from falling when installing roof shingles on a two-story new build single family home. The employee was exposed to a fall of up to approximately 18 feet from the upper roofs edge to the ground below without any form of fall protection in place.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  a. Located at 5 Cider Mill Drive Lot 21, Ashville, oh 43103: On or about January 25, 2024, the employer failed to ensure a non-self-supporting ladder used to ascend/descend the roof of the home was setup at a proper angle.  An employee utilized an extension ladder at the jobsite where the angle from the ladders top support to the feet was approximately half the working length of the ladder. This angle of the ladder deviated from the required angle and compromised the stability thereby exposing the employee to a fall from over 9 feet.
