29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:   (a)Rivera's Drywall at 5400 South Marion Road, Sioux Falls, SD 57106: On or about and at times prior to January 25, 2024, the employer did not ensure that all employees wore appropriate eye and face protection while operating pneumatic nail guns while installing roofing material on a residential property.  This condition exposed employees to struck-by hazards associated flying debris.

29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a)Rivera's Drywall at 5400 South Marion Road, Sioux Falls, SD 57106: On or about and at times prior to January 25, 2024, the exposing employer did not ensure that employees were protected from falls while installing roofing materials on a residential property. This condition exposed the employee to fall hazards greater than six feet.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record to include the name or other identity of the employees trained in fall protection, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer which exposed employees:  (a)Rivera's Drywall at 5400 South Marion Road, Sioux Falls, SD 57106: On or about and at times prior to January 25, 2024, the employer did not ensure that employees were properly trained and certified on the hazards of falls or how to identify hazards prior to being exposed while conducting roofing operations on a residential property. This condition exposed the employee to fall hazards greater than six feet.
