OSH Act of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees? body parts were exposed to being caught-in-between and/or crushed by unprotected moving machinery parts. Location: a) 2nd Floor, 341 9th Avenue, New York, NY 10014 On or about January 26th, 2024, the employer created a hazard by removing a 6? section of the feeder belt on its APBS 3 machine, thereby creating a hole which caused small parcels to fall through. Respondent failed to train its employees on the change to the equipment, which resulted in an injury. 2nd repeat: U.S. Postal Service was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.212(a)(1), which was contained in OSHA inspection number 1555050, Citation number 2, Item number 2 and was affirmed as a final order on March 28, 2022, with respect to a workplace located at 3701 West Wendover Avenue, Greensboro, NC 27495. U.S. Postal Service was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(2), which was contained in OSHA inspection number 1203272, Citation number 1, Item number 1 and was affirmed as a final order on March 20, 2017, with respect to a workplace located at 660 Westfield Road, San Francisco, CA 94128. Feasible abatement methods include training mail handlers working on the APBS 3 machine to recognize hazards associated with machine guarding and the means and methods to eliminate or minimize these hazards. Developing, documenting and utilizing procedures for mail handlers working on the APBS 3 machine when troubleshooting and clearing clogs in the processing lines of the machine following a new configuration and/or modification of that machine.
