29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a.) On January 26, 2024, the employer failed to ensure that the employees were trained in the recognition and avoidance of unsafe conditions such as but not limited to fall hazards, and the use of fall protection at the worksite as a result employees were exposed to fall hazards of 16'8" while conducting roof sealing work.

29 CFR 1926.502(a)(2):Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. a.) On or about January 26, 2024, the employer failed to protect employees from falls, while conducting roof work in that the employer did not properly erect a flagging system with a designated safety monitor exposing employees to a fall of 16'8".

On January 26, 2024, the employer did not ensure that the warning line system on the roof was erected on all sides. As a result employees were exposed to a fall while performing roofing work on a commercial flat roof, fall hazard was measured to be at 16'8".
