On or about January 29, 2024 the employer Complete Custom Construction, LLC at jobsite located at 11068 E. Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure that each affected employee used appropriate eye or face protection when performing residential roofing activities on a new build residential structure while exposed to potential struck by hazards (flying particles/debris) while using Bostitch brand pneumatic nail guns.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about January 29, 2024 the employer Complete Custom Construction, LLC at jobsite located at 11068 E. Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure employees were protected from falls while performing residential new construction roofing activities atop a 12-12 pitch steep sloped residential second level roof deck. Three employees were exposed to falls of 17 feet and 6 inches from the peak and falls of 10 feet and 6 inches from the eaves to the ground below.

On or about January 29, 2024 the employer Complete Custom Construction, LLC at jobsite located at 11068 E. Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure that supported scaffold poles, legs, posts, frames, and uprights were plumb and braced to prevent swaying and displacement. Employees were exposed to falls and struck by hazards in that the three tubular scaffold units on site were not properly braced and supported to prevent falls and potential scaffold collapse.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about January 29, 2024 the employer Complete Custom Construction, LLC at jobsite located at 11068 E. Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure when scaffold platforms more than two feet above or below a point of access were being used, that a portable ladders, hook-on ladders, attachable ladders was provided for employees to access the scaffold. Employees were exposed to falls in that cross braces and the frame of the tubular Biljax scaffold were being used as a means of scaffold access.

Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure the components of the tubular scaffolding system used by employees onsite, were inspected by a competent person prior to each shift for visual defects such as cracks, defects in the planking, and missing components. Employees were exposed to fall and struck-by hazards in that the scaffold systems were not inspected for safety and potential collapse prior to being used.
