29 CFR 1926.651(a): All surface encumbrances that were located so as to create a hazard to employees were not removed or supported, as necessary, to safeguard employees: (a) On or about January 27, 2024, the employer did not ensure employees working inside an excavation that measured approximately 6 feet in depth were protected, in that a John Deere 624L Wheel Loader, with an operating weight in excess of 34,000 pounds, was parked adjacent to the southwest access ramp of the excavation. Employees were working at the bottom of the excavation while being outside the protection of a shield system. This condition exposed employees to a crushing hazard by excavation wall cave-in. (b) On or about January 27, 2024, the employer did not ensure employees working inside an excavation that measured approximately 6 feet in depth were protected, in that a John Deere 200G,-Tier, Mid-Size Excavator, with an operating weight in excess of 45,000 pounds, was parked on top of the primary spoil pile directly adjacent to and along the West side of the of the excavation. Employees were working at the bottom of the excavation while being outside the protection of a shield system. This condition exposed employees to a crushing hazard by excavation wall cave-in. (c) On or about January 27, 2024, the employer did not ensure employees working inside an excavation that measured approximately 6 feet in depth were protected, in that the spoil pile for the approximate 34,918 Cubic Feet of earth removed from the excavation, was positioned directly adjacent to the excavation. Employees were working at the bottom of the excavation while being outside the protection of a shield system. This condition exposed employees to a crushing hazard by excavation wall cave-in. (d) On or about January 27, 2024, the employer did not ensure employees working inside an excavation that measured approximately 6 feet in depth were protected, in that the approximately 36 concrete pipes were positioned directly adjacent to the exaction, along the South edge and the earthen access ramp. Employees were working at the bottom of the excavation while being outside the protection of a shield system. This condition exposed employees to a crushing hazard by excavation wall cave-in.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) On or about January 27, 2024, the employer did not ensure that the spoil pile was at least two feet from the edge of the excavation. Employees worked in the excavation that was approximately 133 ft long, 43 ft wide, and 6 ft deep. The approximate 34,918 cubic feet of materials removed from the excavation was staged directly adjacent to the West excavation wall and ran the 133 ft length of the excavation. This condition exposed the employees to the hazard of spoil pile material falling into the excavation or causing the excavation wall to collapse.

The excavation had near vertical walls, which were approximately six feet deep. This condition exposed subcontractor employees to a crushing hazard by excavation wall cave-in.

This condition did not provide employees with a safe means of egress.
