29 CFR 1910.1053(c): The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 mcg/m^3, calculated as an 8-hour TWA: a: In the south plant, an employee working as a wet operator was exposed to Crystalline Silica at an 8-hour Time Weighted Average (TWA) of 72.27 micrograms per cubic meter (mcg/m^3,) 1.44 times the permissible exposure limit (PEL) of 50 mcg/m^3. The sampling was performed during one shift on February 15, 2024. The exposure level was derived from two samples collected over a 378-minute sampling period. Zero exposure was assumed for the remaining 102-minutes.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a: South Plant, a quality control employee, was exposed to continuous noise levels at 134.8% of the adjusted 12-hour Action Level (84.1 dBA). The equivalent dBA level of 134.8% is 92.15 dBA. The sampling was performed for 694 minutes during one shift on February 15, 2024. Zero exposure was assumed for the 26-minute period not sampled.
