29 CFR 1910.151(b): In the absence of an infirmary, clinic, or hospital in near proximity to the workplace which is used for the treatment of all injured employees, a person or persons shall be adequately trained to render first aid. Adequate first aid supplies shall be readily available. a) On 1/8/2024, an employee was injured while in the process of building wooden bunks utilizing a Everwin nail gun PN58, during the process the employee shot two 1 3/4" nails into the right knee, in that in lieu of 911 being called the employee was transported to a hospital that was not within 3-4 minutes of the facility.

29 CFR 1910.242(a): General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. a) On 1/8/2024 the employer did not ensure that the Everwin nail gun PN58 that employees were using to build wooden bunks was in proper working order to ensure the safety of the employees. The employer could not identify which Everwin nail gun PN58 in the facility was involved in the incident, to determine the portable tool safe condition prior to and after the incident.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On 1/8/2024, an employee was hospitalized for a work-related injury and the employer did not report a reportable injury to OSHA within the required twenty-four hours.
