29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction located at 5010 Heirloom Overlook, Cumming, GA 30028, Roof: On or about 01/31/2024, the employer exposed employees to fall hazards of approximately 10-feet, 8-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in painting activities.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided: a) New residential construction located at 5010 Heirloom Overlook, Cumming, GA 30028, Front side of structure/roof: On or about 01/31/2024, the employer exposed employees to fall hazards at approximately 10-feet, 8- inches to the lower ground level, in that a safe means of access to the roof was not provided as employees were using the frames of a tubular welded masonry walk-thru scaffold to access the roof.
