29 CFR  1926.28(a):The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:  On or about January 31, 2024, and at times prior to, employees  were exposed to struck-by hazards while working around heavy equipment such as mini-excavator, skid steer, and 18-wheeler trucks without being required to wear wearing high visibility vests or other personal protective equipment.
