29 CFR 1910.119(h)(3)(iv):The contract employer did not assure each contract worker follows safe work practices of the facility: Ammonia Refrigeration, Inc. at the jobsite located at 4413 West Bogart Road in Sandusky, Ohio: Instance A On or about December 16, 2023, the employer did not assure that each employee follows the safety rules of the facility including the safe work practices. Employees did not implement lock out tag out procedures as outlined in 29 CFR 1910.147 to control the electrical, pressure, and chemical energy sources when replacing the Park RS solenoid valve coil on the Frick RXF-85-H High Stage Compressor (5A) located in the west engine room. Employees were exposed to hazards associated with liquid ammonia including, irritation to the eyes, nose, and throat, chest pain, skin burns, and frost bite. Instance B On or about December 16, 2023, the employer did not assure that each employee follows the safety rules of the facility including the safe work practices. Employees did not implement line break procedures per the host employer's Line Break Procedure Guidelines prior to replacing the Park RS solenoid valve coil on the Frick RXF-85-H High Stage Compressor (5A) located in the west engine room. Employees were exposed to hazards associated with liquid ammonia including, irritation to the eyes, nose, and throat, chest pain, skin burns, and frost bite.

29 CFR 1910.119(n):The employer did not establish an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38: Ammonia Refrigeration, Inc. at the jobsite located at 4413 West Bogart Road in Sandusky, Ohio: On or about January 31, 2024, the employer did not establish and implement an emergency action plan outlining: (1) the procedures for reporting a fire or other emergency such as an ammonia leak, (2) procedures for emergency evacuation, (3) procedures to be followed by employees who remain to operate critical plant operations, (4) procedures to account for all employees, (5) procedures to be followed by employees performing rescue or medical duties, and (6) the name or title of every employee who may be contacted by employees who need more information of the plan or an explanation of their duties under the plan. Employees were exposed to hazards associated with emergencies such as, but not limited to, fire and explosions resulting from a release of anhydrous ammonia.
