29 CFR 1910.1200(e)(1) As referenced by 29 CFR 1926.59: The employer had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:  On or about January 31, 2024, an employee engaged in commercial roofing activities, located at 15660 Maple Ave., Omaha NE, 68116, was exposed to chemical hazards in that the untrained employee was working with a hazardous chemical while conducting the commercial roofing operations without a company generated Hazardous Communication program in place.

29 CFR 1910.1200(h)(1) As referenced by 29 CFR 1926.59: Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area, as required by 1910.1200(h)(1).  On or about January 31, 2024 an employee engaged in commercial roofing activities, located at 15660 Maple Ave., Omaha NE, 68116, was exposed to chemical hazards in that the employee was working with a hazardous chemical while conducting the commercial roofing operations without having be given training in the use of the chemical.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest system.  On or about January 31, 2024, an employee engaged in commercial roofing activities, located at 15660 Maple Ave., Omaha NE, 68116, was exposed to fall hazards in that the employee was working in excess of 6-feet while conducting commercial roofing operations without fall protection. Instances include, but are not limited to:  a.  Employees accessing the southern portion of the roof immediately following egress/access of the ladder. b.  Employees conducting roofing work without any fall protection systems, directly adjacent to a 36-inch parapet wall.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about January 31, 2024, an employee engaged in commercial roofing activities, located at 15660 Maple Ave., Omaha NE, 68116, was exposed to fall hazards in that the employee was accessing and egressing an elevated work surface with an extension ladder that did not extend 3-feet above the surface being accessed.
