29 CFR  1926.451(b)(1)(i):  Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows: Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) shall be installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform).   On or about January 23, 2024, at 6323 CTH LS in Manitowoc, Wisconsin, an employee was exposed to a fall hazard while working from scaffold 6 feet above surface level without it fully planked.

29 CFR  1926.454(a)(2):  Training requirement.  The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used.   On or about January 23, 2024, at 6323 CTH LS in Manitowoc, Wisconsin, the employer did not provide required scaffold safety training for an employee who was working from a platform without the scaffold fully planked.

29 CFR  1926.501(b)(13):  "Residential construction."  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On or about January 23, 2024, at 6323 CTH LS in Manitowoc, Wisconsin, an employee was exposed to a fall hazard while working on a roof surface 11 feet above surface level without using fall protection equipment.

29 CFR  1926.503(b)(1):  The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On or about January 31, 2024, at 6323 CTH LS in Manitowoc, Wisconsin, the employer did not provide required written fall protection safety training certifications for employees exposed to fall hazards.
