29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:   a. 855-857 Bergen Avenue, Jersey City, NJ  The employer did not provide abatement certification and documentation for inspection number 1725490 citation # 1 Item # 1, Citation # 1 item # 2 and citation #1 item #3 pertaining to 1926.102(a)(1), 1926.501(b)(1) and 1926.1153(c)(1) respectively which were due on 08-16-2024. The employer was issued the citation and notification of penalty on 08-01-2024.  Violation occurred on or about  February 18, 2025.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a. 855-857 Bergen Avenue, Jersey City, NJ   An employee operated power hand tools, such as a Husqvarna Masonry Saw K 770, without the appropriate face protection. The equipment was being used to cut lintels on a mixed residential building under construction.   Violation occurred on or about 02/02/2024

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a. 855-857 Bergen Avenue, Jersey City, NJ  The employer failed to ensure that the employee was protected from falling from an unprotected edge while cutting lintels on mixed residential building under construction. The employee was working at the height of approximately 30  feet from the ground without utilizing any form of fall protection.  Violation occurred on or about 02/02/2024

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a. 855-857 Bergen Avenue, Jersey City, NJ  The employer did not implement engineering controls in accordance with Table 1 for cutting masonry block.  An employee used a Husqvarna  K-770 saw to cut block without any type of water delivery system or water dust suppression.   Violation occurred on or about 02/02/2024
