29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  Location: Job site;  On or about 01/19/2024, frequent and regular inspections of the job site, materials and equipment were not accomplished by a competent person. The competent person listed for this job site failed to correctly identify and mitigate a fall hazard and struck-by hazards for employees who were performing framing activities without the use of fall or eye protection.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Location: Job site;  On or about 01/19/2024, multiple employees were not protected from falling to a lower level by the use of guardrail systems, safety nets, or personal fall arrest systems in the following instances:  a) 6 Employees were not protected from a fall of 9-feet to the concrete floor of the second level while performing framing activities on the floor joists of the 3rd story.  b) An employee was witnessed reaching outside the guardrail system erected at the top of the structure in order to secure exterior building materials with a pneumatic nail gun, exposing them to a fall of approximately 18-feet to the ground below.
