29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck. At the commercial worksite located at 232 N Baltimore Street in Kansas City MO 64116: Employees are exposed to struck by hazards in the form of improper use, seatbelts, driving speed, and unsecured loads. The employer exposed the employee to these hazards by allowing them to operate a powered industrial truck without first ensuring that the employee received initial training for operating the powered industrial truck.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: At the commercial worksite located at 232 N Baltimore Street in Kansas City, Missouri 64116: Employees were exposed to toxic and hazardous substances in the form of mineral spirits, paints, oils and fuels, as well as skin conditions including but not limited to dermatitis or undetected medical conditions while using these chemicals in the manufacturing process of the mill parts. This was most recently demonstrated on or about February 6, 2024, and at times prior, when employees were not informed of the hazards associated with working with these chemicals. Hazards from these products include fires, respiratory conditions, and skin contact illnesses; the employer had not conducted training on the hazard communication program.
