29 CFR  1910.132(d)(1):The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  (d)(1)(i):   Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; (d)(1)(ii):  Communicate selection decisions to each affected employee; and, (d)(1)(iii): Select PPE that properly fits each affected employee.  (a) On or about 02/06/2024, the employer did not adequately assess the workplace for hazards, through implementation as required by elements d(1)(i)-d(1)(iii) with regards to hazards present, and by determining the appropriate PPE such as tight sealing safety googles for employees on the production floor producing chemicals that can splash or spill such as but not limited  the manufacturing of apple cider vinegar and liquid dishwashing soap.

29 CFR  1910.132(f)(1): The employer shall provide training to each employee who is required by this section to use PPE. Each such employee shall be trained to know at least the following:  (f)(1)(i): When PPE is necessary; (f)(1)(ii): What PPE is necessary; (f)(1)(iii): How to properly don, doff, adjust, and wear PPE; (f)(1)(iv): The limitations of the PPE; and, (f)(1)(v): The proper care, maintenance, useful life and disposal of the PPE.   (a) On or about 02/06/2024, the employer did not provide adequate training and implementation of the required elements f(1)(i)-f(1)(v), including mandating when appropriate PPE such as tight sealing safety googles needs to be worn by employees on the production floor producing chemicals that can splash or spill such as but not limited to apple cider vinegar and liquid dishwashing soap.

29 CFR  1910.178(k)(1): The brakes of highway trucks shall be set and wheel chocks placed under the rear wheels to prevent the trucks from rolling while they are boarded with powered industrial trucks.  a) On or about 2/05/2024, employer did not ensure that the brakes of a semi-truck(US DOT# 2608851 , KYU# 354735) were set to prevent the truck from driving away while a Hyster forklift ( SN# A268N06609J) and it's operator attempted to board the back of the truck at bay dock door 2 in outbound. The truck pulled off while the operator was entering the truck as they were loading a pallet exposing the operator to a 4ft fall from the dock.  b) On or about 2/06/2024, employer did not ensure that the wheel chocks were placed under the rear wheels of semi-truck docked at bay dock door 2 in outbound during loading operations. A truck was observed running over the chock as it was pulling off.

1910.178(l)(3) Training program content. Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace.  (l)(3)(ii)(I):Other unique or potentially hazardous environmental conditions in the workplace that could affect safe operation.  a) On or about 02/05/2024, employer did not ensure that employees operating forklifts were adequately trained on potentially hazardous conditions such as but not limited to dock safety procedures to include ensuring semi-trucks are chocked and brakes set to prevent semi truck operators from driving off or rolling over chocks while forklift operators are loading the truck.  Driving off the docks exposes employees to a 4' drop from the docks in a Hyster(E50XN-33 SN:A268N06609j) forklift.

29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  (e)(1)(i)A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and, (e)(1)(ii)The methods the employer will use to inform employees of the hazards of non-routine tasks (for example, the cleaning of reactor vessels), and the hazards associated with chemicals contained in unlabeled pipes in their work areas.  a) On 02/06/2024, employer did not develop a written hazard communication program with chemical lists and training information, for employees filling bottles of chemicals on the production floor such as but not limited to Liquid Dishwashing soap and apple cider vinegar.

The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  a) On or about 2/6/2024, the employer could not provide certification of training for an employee who was operating the a Forklift (Hyster E50XN-33 SN:A268N06609J).
