29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard. On or about February 7th, 2024, employees engaged in meat processing operations located at 320 Commerce Street, York, Nebraska 68467 were being exposed to amputation hazards in that the feed hopper that contains an auger was not protected from an employee falling into or onto the internal components of the auger. Employees would be required to access the stairwell and look directly over the hopper looking for foreign material or meat that was stuck in the auger.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: On or about February 7th, 2024, employees engaged in material handling operations located at 320 Commerce Street, York, Nebraska, 68467 were being exposed to stuck-by hazards in that the employer pre-fabricated an in house forklift attachment that was designed to load combos as well as the employer drilled two holes in the forks of the forklift without manufacturer approval.
