29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Tsunami Construction LLC, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a serious violation of 29 CFR 1926.102(a)(1) with an abatement date of June 11, 2024.  Citation 1, Item 2,  Group a, a serious violation of 29 CFR 1926.501(b)(13) with an abatement date of June 11, 2024.  Citation 1, Item 2, Group b, a serious violation of 29 CFR 1926.503(b)(1) with an abatement date of June 25, 2024.  Citation 1, Item 3, a serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of June 11, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about February 7, 2024, at the jobsite located at 1379 Windwood Road, Oconomowoc WI, an employee was performing roofing work on a single story residential building using a pneumatic nail gun, and did not use eye protection.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about February 7, 2024, at the jobsite located at 1379 Windwood Road, Oconomowoc WI, employees were performing roofing work on an 8:12 pitch single story residential building without fall protection. This exposed employees to a fall of approximately 11 feet 5 inches to the ground below.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) On or about February 7, 2024, at the jobsite located at 1379 Windwood Road, Oconomowoc WI, employees were  performing roofing work on a single story residential building roof with an 8:12 pitch without fall protection,  thereby exposing the employees to a fall hazard approximately 11 feet 5 inches. Employees had not been trained to recognize and implement fall protection methods.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   (a) On or about February 7, 2024, at the jobsite located at 1379 Windwood Road, Oconomowoc WI, an employee accessed the roof from a ladder which did not extend at least three feet above the roof.
