29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) On or about February 7, 2024, and at times prior, maintenance employees were exposed to inhalation hazards. Maintenance employees perform emergency work such as repairing leaks involving cutting into drywall or other asbestos containing materials in apartment units. Maintenance employees also perform routine maintenance work that causes asbestos disturbance. Maintenance employees also occasionally wear respirators when sanding spackle. The employer did not administer a written respirator program.

The employer did not ensure workers that are required to wear respirators were medically evaluated. Maintenance employees perform emergency work such as repairing leaks involving cutting into drywall or other asbestos containing materials in apartment units, and the maintenance employees perform routine work that causes asbestos disturbance. Maintenance employees also occasionally wear respirators when painting.

The employees on the maintenance team were not provided training on asbestos fiber release as they should be annually.
