29 CFR  1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  On or about January 24, 2024, employees were exposed to a respirable crystalline silica based Grain I Grit material due to powered industrial vehicles driving continuously over the material for three consecutive days. The material became airborne due to being driven over and crushed causing a respiratory hazard for the employees working in the shipping and receiving area. A leaf blower was also eventually used to clear the remaining Grain I Grit Material off and away from the shipping and receiving area causing a higher chance of employees to be exposed to the airborne hazard.

29 CFR  1910.1053(f)(2)(i): The employer did not establish and implement a written exposure control plan:   On or about January 24, 2024, the employer did not establish and implement a written exposure control plan for employees who were exposed to a silica based Grain I Grit material due to powered industrial vehicles driving continuously over the material for three consecutive days. The material became airborne due to being driven over and crushed causing a respiratory hazard for the employees working in the shipping and receiving area. A leaf blower was also eventually used to clear the remaining Grain I Grit Material off and away from the shipping and receiving area causing a higher chance of employees to be exposed to the airborne hazard.

29 CFR  1910.1053(j)(1):The employer did not ensure that each employee has access to labels on containers of crystalline silica and safety data sheets:  On or about February 9, 2024, the employer did not provide proper labeling on the container of material consisting of crystalline silica and did not provide safety data sheets.  a. A safety data sheet for the silica based Grain I Grit material that employees had utilized to prevent the forklifts from sliding on the concrete floor was not available to employees.   b. The oil dry material stored in the container in the shop did not have a label on the container indicating the health hazards of the material containing silica.

29 CFR  1910.1053(j)(3)(i): Employee information and training. (i) The employer shall ensure that each employee covered by this section can demonstrate knowledge and understanding of at least the following:        *(A): The health hazards associated with exposure to respirable crystalline silica;        *(B): Specific tasks in the workplace that could result in exposure to respirable crystalline silica;        *(C): Specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and respirators to be used;        *(D): The contents of this section;        *(E): The purpose and a description of the medical surveillance program required by paragraph (i) of this section.  On or about January 24, 2024 employees were exposed to a silica based Grain I Grit material due to powered industrial vehicles driving continuously over the material for three consecutive days. The material became airborne due to being driven over and crushed creating a respiratory hazard for the employees working in the shipping and receiving area. The employees had not been trained on the health hazards of the material that they were exposed to.
