29 CFR  1926.102(a)(1):Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) On or about February 8, 2024, at a worksite located at 4625 Van Ness Street NW, second floor; employees engaged in framing were not wearing eye protection provided while operating pneumatic tools such as nail guns.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.403(b)(2):Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  a) On or about February 8, 2024, at a worksite located at 4625 Van Ness Street NW, second floor, employees engaged in residential construction activities were using an electrical non-metallic wall box designed to be mounted as an outlet extension cord exposing the employees to a shock hazard.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.404(b)(1)(ii):On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupters for personal protection.  a) On or about February 8, 2024, at a worksite located at 4625 Van Ness Street NW, first-floor area, employees were exposed to electrical shock while operating portable electrical equipment such as circular saws that were not connected to a ground-fault circuit interrupter while framing the residential home.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. 29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about February 8, 2024, at a worksite located at 4625 Van Ness Street NW, second floor, employees were observed walking the top plate while installing the trusses on the residential home without fall protection in place to protect them, falling approximately 20 feet to ground level.  b) On or about February 8, 2024, at a worksite located at 4625 Van Ness Street NW, first-floor area, the stairs used to access the upper floor were not protected with railing, exposing the employees to a 10-foot fall to the wooden deck below.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.  The Protector Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1443591, citation number 1, item number 1 and was affirmed as a final order on (9/8/2020, with respect to a workplace located at 246 11th Street NE Washington DC 20010.
