29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) Kirby Risk located at 1249 Stewart Road, Lima, Ohio, 45801: On or about February 5, 2024, the employer failed to ensure that each employee tasked with operating powered industrial vehicles such as, but not limited to, the battery powered Crown FT123 (model: 35RRTT-S SN: H-13017) stand up forklift were adequately trained through a combination of formal instruction, practical training and evaluation prior to operating the powered industrial vehicles throughout the warehouse. Power industrial vehicle operators and pedestrians were exposed to potential struck-by and crushing hazards in that employees operated the vehicles without the benefit of training.

Employees performing inventory activities such as, but not limited to, counting the 10ft conduit in the warehouse while elevated upon this mobile scaffold were exposed to fall hazards to the concrete floor below.

The employee working atop the elevated scaffolding platform in this condition was exposed to fall hazards to the concrete floor below.
