29 CFR 1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a). On or about February 2, 2024, the employer did not ensure that frequent and regular inspections of the jobsite were conducted; as a result employees were exposed to fall hazards from damaged fall protection equipment being in use, and the absence of fall protection working at a height of 12'3".

29 CFR 1926.502(a)(2):Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. a.) On or about February 2, 2024 the employer failed to provide and install a fall protection system before employees began working on the installation of new balcony patios. As a result employees were exposed to a fall hazard of 12'3" above ground level. The employer Bonilla Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.502 (a)(2), which was contained in OSHA Inspection Number 1664880, citation number 1, item number 2,and was affirmed as a final order on 8/14/2023, with respect to a workplace located at 7832 Five Mile Rd, Vantage at Anderson Towne Center, CINCINNATI, OH 45255.

29 CFR 1926.502(d)(21): Personal fall arrest systems shall be inspected prior to each use for wear, damage and other deterioration, and defective components shall be removed from service. a) On or about February 2, 2024, the employer failed to inspect the lanyards prior to each use for wear, damage, and other deterioration. As a result, employees were utilizing compromised lanyards that should have been removed from service exposing employees to falls.
