29 CFR  1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer  a) On February 8, 2024, the employer did not ensure that a frequent and regular inspection program of the job site and equipment was being performed by a competent person, and as a result, no fall protection systems and/or devices were installed and utilized exposing employees to fall hazards; employees were also exposed to fall hazards while using ladders positioned at angles greater than a 4:1 ratio. Fall height measured to be 11'3" from the ground to the roof's eave.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a.) On February 8, 2024, the employer failed to ensure employees were protected from falls as they conducted roofing work on a 16-12 pitched roof in that no fall protection system was set or provided for employees exposing them to a fall hazard of 11'3".

29 CFR  1926.1053(b)(5)(i): Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).    a) On February 8, 2024, the employer did not ensure that ladders being used by employees for residential roofing work were set up at an angel equal to one-quarter of the working length (0.25); in that, the ladders were being used at a set up ratio of 0.6, exceeding the required ratio of non-self-supporting ladders by more than twice (2.4) and exposing employees to fall hazard of 11 feet 3 inches to hard ground below.
