29 CFR 1910.178(q)(7): Industrial trucks were not examined at least daily before being placed in service: (a)VRC Metal Systems, LLC at 600 North Ellsworth Road, Box Elder, SD 57719: On or about and at times prior to February 13, 2024, the employer did not ensure that a Toyota Pallet Jack powered industrial truck, Model Number: 8HBW23, Serial Number: 8HBW23-38377, was being examined at least daily prior to use. This condition exposed employees to struck-by hazards associated with inoperable powered industrial trucks. (b)VRC Metal Systems, LLC at 600 North Ellsworth Road, Box Elder, SD 57719: On or about and at times prior to February 13, 2024, the employer did not ensure that a Toyota powered industrial truck, Model Number: 8FGCU32, Serial Number: 73294 was being examined at least daily prior to use. This condition exposed employees to struck-by hazards associated with inoperable powered industrial trucks.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section: (a)VRC Metal Systems, LLC at 600 North Ellsworth Road, Box Elder, SD 57719: On or about and at times prior to February 13, 2024, employees were exposed to chemical hazards in that not all hazardous chemicals in the workplace were labeled. One clear bottle containing Tool Black Liquid, located within the HAZMAT cabinet on the west wall of the Qualification Booth Area was not labeled. This condition exposed employees to injuries with improper use of chemicals.
