29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  On February 12, 2024, on the north side of the construction site, employees engaged in roofing work without fall protection were exposed to unprotected fall hazards of approximately 9 feet to the ground below.   Eduardo Ruiz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1658638, citation number 02, item number 002 and was affirmed as a final order on May 2, 2023, with respect to a workplace located at 2737 Acadia Drive, Corinth, TX 76210.  This inspection is currently in collections at the U.S. Treasury with current penalties of $25,866.45.  Eduardo Ruiz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1631128, citation number One, item number Two and was affirmed as a final order on November 30, 2022, with respect to a workplace located at 4112 Kyles Landing, Hickory Creek, TX.  This inspection is currently in collections at the U.S. Treasury with current penalties of $6,945.28.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  On February 12, 2024, on the north side of the construction site, employees using extension ladders that did not have the side rails extended three feet over the upper landing surface were exposed to potential fall hazards greater than six feet.  a) Werner ladder located on the north side did not extend 3 feet above the landing, b) Werner ladder on the south side did not extend 3 feet above the roof landing, c) Werner ladder on the west side did not extend 3 feet above the roof landing.  Eduardo Ruiz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1658638, citation number 03, item number 001 and was affirmed as a final order on May 2, 2023, with respect to a workplace located at 2737 Acadia Drive, Corinth, TX 76210. On the construction site, the employer did not develop or provide fall protection training to the employees engaged in roofing work while working over 6 feet to recognize and eliminate hazards such as fall protection.

29 CFR  1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways.  On the construction site, the employer did not develop or provide ladder training to the employees engaged in roofing work on how to recognize and eliminate hazards such as fall hazard from ladders.
