29 CFR  1910.22(a)(3): 29 CFR 1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice etc.:  On or about February 13, 2024, the employer failed to ensure that the walking and working surface of the main plant floor near and around the Lake Erie Press #3, was free from hazards, such as but not limited to, floor opening all around the perimeter of the press.  Employees are exposed to hazards such as slip and fall into the openings.

29 CFR 1910.22(d)(1): Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition:  On or about February 13, 2024, the employer failed to inspect the walking and working surface areas, specifically around the Lake Erie Press #3, to ensure it was free from hazards, such as but not limited to, floor opening all around the perimeter of the press.  Employees are exposed to hazards such as slip and fall into the openings.

29 CFR  1910.22(d)(2): 29 CFR 1910.22(d)(2): The employer did not ensure that hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. The employer did not ensure that if the correction or repair cannot be made immediately, the hazard is guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired:   On or about February 13, 2024, the employer failed to correct the open floor holes that were around the Lake Erie Press #3, which is where employees are walking and/or working throughout the day.  Employees are exposed to hazards such as slip and fall into the openings.

29 CFR  1910.28(b)(6)(i): 29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard.   On or about February 13, 2024, the employer failed to ensure that employees were protected from falling into or onto dangers equipment, including but not limited to, Press #2.  The press has a lift basket/working platform on each front side.  The employees ride up approximately 7+ feet in these lift baskets/working platforms to load materials into the various levels of the press.  One of the gate doors on one of the platform lift baskets was missing the door.

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a)  On or about February 13, 2024, the employer failed to ensure that there was effective guarding on the AccurShear Machine #61354.  Employees were exposed to struck by  and/or caught in between hazards from the moving parts of the hold down plunger of the machine as well as the cutting blade which is just behind the plungers when hand feeding various sized laminate material sheets into the machine.  b)  On or about February 13, 2024, the employer failed to ensure that there was effective guarding on the Sheeter machine.  Employees are exposed to struck by  and/or caught in between hazards from the moving ingoing rollers of the machine as well as the blade which is just behind the rollers  when hand feeding various sized laminate material sheets into the machine.  c)  On or about February 13, 2024, the employer failed to ensure that there was effective guarding on the rear of Press #2.  Employees are exposed to struck by and/or caught in between hazards of the moving parts/various plate levels of the press in the rear (the press plates on the various levels) when they have to hand push in the materials that come out of place in the press during operation back into the press.

On or about February 13, 2024, the employer failed to report a partial fingertip amputation that occurred on November 17, 2023.  An employee sustained a partial fingertip amputation while operating the AccurShear Machine #61354.
