29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. At a worksite located at 8131 Holmes Road, Kansas City, MO 64131: Employees were exposed to struck-by and crushing hazards. This was demonstrated on April 5, 2022, when employees worked in an unprotected excavation where excavated materials were placed at least 2 feet or less from the edge of the excavation. Employees were working to install new water and sewer lines to a new residential home and were not provided with protection from falling materials by placing the material at another location or further than 2 feet from the excavation edge.

29 CFR 1926.652(a)(1)(ii): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph 29 CFR 1926.652(b) or 29 CFR 1926.652(c) of this section except when: excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. At a worksite located at 8131 Holmes Road: Employees were exposed to struck-by and crushing hazards. This was demonstrated on February 13, 2024, when employees were working in an unprotected excavation greater than 5 feet in depth. Employees were working to replace a sanitary sewer line at residential home and were not provided with any benching, sloping, or other engineered protective systems.
