29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:  a) On or about 2/12/2024 at a roof project located at 450 West Utica Street, Buffalo, New York; employees, replacing the roof of a two story building, were using a ladder jack scaffold, with the scaffold brackets and platform to the outside of the supporting ladders. The employees accessed the platform by climbing the supporting ladders and climbing around the bracket and platform.  NO ABATEMENT CERTIFICATION REQUIRED  A & C CONSTRUCTION 1 CORP.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1688998, citation number 1, item number 1 and was affirmed as a final order on 10/12/2023, with respect to a workplace located at 514 Connecticut Street, Buffalo, New York.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) On or about 2/12/2024 at a roof project located at 450 West Utica Street, Buffalo, New York; employees were replacing the roof of a two story house. The roof had an 9 in 12 pitch and an eave height of approximately 18 feet. There was no fall protection in use. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about 2/12/2024 at a roof project located at 450 West Utica Street, Buffalo, New York; employees were placing shingles on the roof of a two story house. Employees were accessing the roof with an extension ladder and the side rails of the ladder did not extend 3 feet above the landing surface. The ladder was below the eave eave and employees had to climb around the overhang.
